5% tax on downloads

circulating in the gameblogs today I saw this.

I'm wondering how they will collect this tax. If I buy a microsoft point card to be used on xbox live marketplace, do I pay tax on the card, or will my charge for the items I purchase with the card go up 5%?
They already collect a sales tax on the cards, so if they collect online too, I'll be double taxed.

Or I could buy my card online and change my system address to another state and pay nothing.

I just don't see a way to implement this that makes sense and can't be easily avoided by anyone who regularly buys things online.

Overall, this won't affect me from a cost standpoint, since this law will make absolutely certain that there is less available for me to purchase online.
