BREAKING HARD: Obama Care on Life Support?

Obama Care crumbling? One can only hope...

Florida Judge Rules Against ObamaCare, Individual Mandate Unconstitutional

In a ruling out of the U.S. District Court in Pensacola Justice Roger Vinson has declared that the primary mechanism whereby the health reform achieves universal insurance coverage–the individual mandate–is unconstitutional.

With this ruling, and a similar one in December by Judge Henry Hudson in Virgina, it’s likely that the U.S. Surpreme Court will be the final arbiter of whether ObamaCare stands. (Two other lawsuits–one in Michigan and one in Virginia–were thrown out by other federal district judges last year who disagreed with the constitutional challenge.)

I agree. We should take out the mandate which was only a cost control measure thought up by Republicans in the nineties and replace it with a low cost government option for coverage.

What would the elimination of the cost-controlling mandate do to the CBO's infallible cost/savings figures? They evaluated the bill as written, not as it would be implemented in reality. And weren't those savings estimates a major reason why this bill was passed in the first place? Hmm.

Law of unintended consequences. If the Tea Party/GOP are successful in getting the individual mandate invalidated without being able to nullify the other provisions of the law, most of which a majority of Americans want, it will eventually break the backs of the insurance corporations. This will open the door, if not necessitate, that a public single payer system be established.

Thank the Lord! When all those kids with diabetes can't get insurance, just like in the good ol' days, my life will be so much better.

I can't wait until some judge makes it unconstitutional to not torture Guantanamo detainees. We might get an impeachment out of this yet!

Unintended consequences indeed. Don't fail to apply this concept when considering previous regulatory forays into the health industry, or any peaceful private industry for that matter.

This has gone to court about 16 times so far. With the latest ruling, we have something like 12 cases being thrown out of court for one reason or other, two cases saying it's just fine, and two cases saying it ain't fine.

That's what Republicans call "on life support." These guys want to tell us how to fix health care.

It seems like it's more about what's not in the bill, which is a severability clause.

It's not on life support any more? Now we're just trying to find out what's in the bill?

If I were to guess what we're doing, I'd say we had a faction attempting to kill it regardless of what it does to the country OR what the majority of the country wants.

Or I'd have guessed we were following a long tradition of testing and tempering our laws through judicial means.

I never would have guessed we were trying to find out what's in the bill. But then, I never would have called this current stage "Life support" either.
